Louisiana is a community property state. That is — unless there is a prenuptial agreement or an agreement to have separate property in the marriage — any property collected during marriage is considered marital property and therefore owned fifty-fifty by husband and wife. That also applies to any liabilities that either spouse incurred during the marriage.
After the divorce, once you resolve community property questions, there is a community property settlement agreement that is approved by the court. This agreement is recorded in the public record and sent to any creditors to put everyone on notice as to asset division and debt division.
